Incident Details

DRS Law Personal Injury Lawyers have filed a civil rights lawsuit against the Montgomery County Jail’s medical provider following a troubling incident where an inmate gave birth in a toilet inside her cell. The case, MD Tenn Case No. 3:24-cv-00954, has brought attention to the treatment of pregnant inmates and the protocols in place for their care.

Medical Negligence and Deliberate Indifference

The incident occurred in the Montgomery County Jail in Clarksville, Tennessee, where Alyssia Moulton reportedly alerted authorities about a medical concern. Despite this, she did not receive immediate medical attention. It took over an hour before two nurses assessed her, and by that time, she had already given birth in her cell. Both the mother and the baby were later hospitalized and were reported to be in stable condition.

Criticism and Accountability

This case has sparked criticism from prison reform advocates, who emphasize the risks faced by pregnant women in custody. The lack of immediate medical care raises questions about the accountability of the medical and jail staff involved. The Montgomery County Sheriff’s Office conducted a review of the incident, but details of any actions taken remain undisclosed.

“Tennessee has one of the highest rates of female incarceration in the nation, which itself has one of the highest rates of female incarceration in the world. We hope this lawsuit shines a light on this often-overlooked social issue and raises awareness of the civil rights of pregnant inmates.

Legislative Concerns

State Senator Raumesh Akbari has expressed her concerns, highlighting the importance of dignified treatment for incarcerated women and their children. The incident underscores a broader issue regarding the absence of a consistent national standard for the treatment of pregnant inmates, despite existing policies in many correctional facilities.

Broader Implications

This lawsuit is part of a larger pattern of legal actions taken by women who have experienced similar situations while incarcerated. These cases often result in settlements and highlight the urgent need for improved care and protocols to ensure the well-being of pregnant inmates and their newborns.

Civil Rights Lawyer Christopher Smith provided the following statement:

We look forward to bringing this important case on behalf of Ms. Moulton and her child.  This case raises important questions about the incarceration of pregnant women.  Tennessee has one of the highest rates of female incarceration in the nation, which itself has one of the highest rates of female incarceration in the world. We hope this lawsuit shines a light on this often-overlooked social issue and raises awareness of the civil rights of pregnant inmates.
