Have you been injured due to someone else’s negligence? You might be wondering if you need a negligence lawyer. If you’re unsure what a negligence lawyer is or how they can help, this blog post is for you.

What is Negligence?

Negligence is a legal term that describes a situation where someone fails to act with reasonable care, resulting in harm to another person. To prove negligence, four elements must be present:

    1. Duty of Care:  The defendant owed the plaintiff a duty of care.  This means the defendant had a legal obligation to act in a way that wouldn’t harm the plaintiff.
    2. Breach of Duty:  The defendant breached their duty of care by failing to act with reasonable care.
    3. Causation:  The defendant’s breach of duty caused the plaintiff’s injuries.
    4. Damages:  The plaintiff suffered damages as a result of the defendant’s negligence.

What does a Negligence Lawyer do?

A negligence lawyer can help you understand your legal rights and options if you have been injured due to someone else’s negligence. They can also help you:

          • Investigate your claim:  This includes gathering evidence,  interviewing witnesses,  and determining the value of your claim.
          • File a lawsuit:  If necessary,  your lawyer will file a lawsuit against the responsible party on your behalf.
          • Negotiate a settlement:  Your lawyer can negotiate a fair settlement with the insurance company or the defendant’s attorney.
          • Take your case to court:  If the insurance company or the defendant’s attorney refuses to offer a fair settlement,  your lawyer can take your case to court.

What types of cases do Negligence Lawyers handle?

Negligence lawyers handle a wide variety of cases, including:

          • Product liability:  This includes injuries caused by defective products.
